Club Motoneige Diable et Rouge (the “Club,” “we,” or “us”) takes the protection of personal information seriously. This policy explains, in clear and simple language, how we collect, use, disclose, retain, and protect personal information when you browse our website, contact us, subscribe to our communications, or use services offered through our Shopify store.

This policy is intended to address the requirements of Quebec’s Act respecting the protection of personal information in the private sector, as modernized by Law 25, as well as the transparency obligations that apply when personal information is collected.

The Privacy Officer oversees compliance with this policy, responds to access and correction requests, and receives privacy questions or complaints.

2. Information we may collect

Depending on how you interact with the website, we may collect:

  • contact information, such as your name, email address, telephone number, and mailing address;
  • information you provide in a form, message, volunteer request, partnership request, or information request;
  • your subscription preferences for Club news;
  • if transactions are offered, the information required to process an order or payment. Full payment-card details are processed by Shopify and its payment providers and are not stored directly by the Club;
  • technical data, such as your IP address, device and browser type, language, pages viewed, date and time of your visit, and cookie identifiers;
  • any other information you voluntarily choose to provide.

We limit collection to information that is reasonably necessary for the purposes described in this policy.

3. How and why we collect information

Information may be collected directly from you through website forms, by email or telephone, during a transaction, or automatically by Shopify through cookies and similar technologies.

We use it to:

  • respond to questions and requests;
  • manage subscriptions and send Club news with your consent;
  • administer Club activities, volunteers, partnerships, and services;
  • process and secure a transaction when a transactional service is offered;
  • operate, secure, measure, and improve the website;
  • prevent fraud, abuse, and security incidents;
  • comply with legal and regulatory obligations.

When consent is required, it is requested separately, for specific purposes, and in understandable language. You may withdraw your consent, subject to applicable legal or contractual restrictions.

4. Cookies and similar technologies

The website uses essential cookies required for its operation. With your consent, preference, analytics, or marketing cookies may also be used to remember your choices, understand website use, and personalize your experience.

On your first visit, a banner lets you accept or decline non-essential cookies and manage your preferences. Declining non-essential cookies does not prevent access to the website’s main content. You can change your choice at any time using the “Privacy preferences” link in the website footer.

5. Disclosure to third parties and processing outside Quebec

We do not sell or rent personal information. We may disclose it only when necessary to service providers that help us operate the website or provide a service, including:

  • Shopify, which hosts the store and processes certain technical, transactional, and personalization data;
  • payment, hosting, storage, security, analytics, or electronic-communications providers;
  • public authorities when required by law, a court order, or a valid legal process.

Some providers, including Shopify, may process or store information outside Quebec or Canada, including in the United States. In those cases, the information may be subject to the laws of the jurisdiction where it is processed. The Club takes reasonable steps to ensure that providers offer appropriate protection.

6. Third-party links and services

The website contains links to external services, including Facebook, iMotoneige, the FCMQ, and certain partners. These organizations apply their own policies. When you leave our website, we encourage you to review their privacy policy.

7. Retention and destruction

We retain personal information only for as long as necessary for the purposes for which it was collected, to meet legal, accounting, or operational obligations, and to resolve disputes. At the end of that period, information is securely destroyed or anonymized in accordance with applicable requirements.

8. Security safeguards and privacy incidents

We apply reasonable administrative, technical, and physical safeguards based on the nature and sensitivity of the information. However, no system is entirely risk-free.

The Club maintains a privacy-incident register. When an incident creates a risk of serious injury, the Club takes the required steps to reduce that risk and notifies affected individuals and Quebec’s Commission d’accès à l’information when required by law.

9. Your rights

Subject to the conditions set out by law, you may:

  • ask whether we hold personal information about you and request access to it;
  • request correction of inaccurate, incomplete, or ambiguous information;
  • withdraw consent or request that certain use or disclosure stop where permitted by law;
  • request deletion of information that is no longer necessary, subject to our retention obligations;
  • where the right applies, request certain computerized information in a structured, commonly used technological format;
  • obtain information about the categories of people who have access to the information and how long it is retained.

The Club does not make decisions about you based exclusively on automated processing. We may reasonably verify your identity before responding to a request. To exercise your rights, email clubdiablerouge@outlook.com.

10. Children’s information

The website is not intended to knowingly collect personal information from a child under the age of 14 without the consent of a parent or guardian, unless permitted by law.

11. Complaints

You may submit a question or complaint to the Privacy Officer using the contact details in section 1. We will review the request diligently. You may also contact Quebec’s Commission d’accès à l’information.

12. Changes to this policy

We may update this policy to reflect changes in our practices, services, or legal requirements. The current version is posted on the website with its revision date. When required by law, notice of a change will be provided through an appropriate method.
